FEES

Some basic understandings
Franchisor-Franchisee relationship

The basis of the relationship is a legal contract known as the franchise agreement. In the franchise agreement both the franchisor and the franchisee bring value to the relationship. Both sides also have risks and rewards in the arrangement as well as freedom and responsibilities. It is without doubt a relationship that requires balancing skills.

What does it mean to “buy a franchise”?

In essence the franchisee is acquiring the rights to operate a franchise. In other words, the franchisee operates a business system that ensures the delivery of a consistent product, service and experience for the customer in a particular territory.
The better the franchisee is at implementing the system, the greater the chance of achieving the intended results for the franchise unit.

Becoming a franchisee

Step 1: Answer the WHY
Common reasons people have offered in the past for joining a franchise include:
- Great brand
- Great product
- Great industry
- Build fund for retirement
- Someone will teach business
- You are not alone
Reasons that should not be acceptable include:
- Everyone is doing this business
- The business is ‘easy money’
- ‘People have made so much money in that business’
Whatever your reasons, be clear that they are your reasons for joining a franchise and not because of how well others are doing or their objectives for joining a particular franchise.

Choosing the right franchise for me

Am I suited for business?

Choosing your franchise consultant

Franchising your business is like setting up a new business. You’ll need a proper plan, proper management, adequate funding and–equally important–professional advice from an experienced franchise consultant.

We’re assuming here that you have a business that’s suitable for franchising. To find out ask yourself these questions:

Have you run a successful business for at least one year? Have you proven your concept? Will it survive in the long term? Is it profitable? Can you produce audited accounts? Do you operate in a niche market or offer something different in an established field? Can your business be replicated and easily taught? Can you offer leadership, strong management, motivation and support?

Can you offer a franchise at a cost that is good value for money, and can it make a decent return on investment in the short to medium term and a good living for its owner?

If you can answer yes to most of these questions you may have a business that can be franchised. At this stage –whether you are creating a new franchise or you are launching an existing system as a Master Franchisee–you will need to find a reputable franchise consultant, someone who knows the market and will put his integrity above self interest.

His opinion will be very important. Franchising is not easy and it’s not cheap. There is no point setting up a franchise which no-one is going to buy. So before you start you need to know where you are going and feel confident that the journey is going to be worth it.

To find a consultant, talk to franchisors who have already gone through the process. They might have a recommendation.  Seek advice from your Franchise Association. Arrange a meeting. Ask the consultant for references and permission to talk to previous clients to see what they think of him. Did he create the franchise on target and to budget. Or was the budget exceeded because he wanted money for “extras” that were not previously discussed?

Franchise Consultant

A consultant should give you a written Proposal, detailing exactly what needs to be done, what his role would be if you hire his services, and how much he is going to cost.

Remember, the consultant can’t do everything on his own: you’ll also have work to do to make the project a success. Your most important responsibility is the Operations Manual, which is the A to Z of your business. It is the franchisee’s primary source of information and guidance and should contain a detailed description of the franchisor’s system and how to operate it on a daily basis.

The manual—together with the Franchise Agreement, which your lawyer will draft—are the two essentials of any franchise. Your consultant can give you a template for this document but, since no-one knows your business better than you do, you should be the one to put it together.

Agree a Check List of what needs doing and schedule meetings or telephone conversations to make sure the project stays on track.

Some consultants will quote an “all in” fee while others will either operate on a per diem basis or seek to recover their fee in staged payments, charging you when each part of the scheduled work is completed. Agree a target date for the completion of the project and set a budget. Take care that fees and expenses do not spiral out of control.

In my experience, creating a franchise should take about three months. It can take longer if the franchisor is unable to finalize his Operations Manual in time.

Bear in mind that the consultant’s fees are only part of the start up costs. Apart from paying for professional advice as to the most cost-effective way of developing your franchise, you’ll need to pay for advertising to attract prospects, collaterals such as brochures and video presentations, and general expenses, including travel, hire of rooms, and entertainment, etc.

Once your franchise consultant has been created, the next step is to sell franchises. Your consultant can tell you how to promote your business to generate leads and how to make those all-important sales.  He may even offer to do it for you—helpful if you don’t have the time or the skills to do  it yourself.

Selling franchises is very time-consuming. Leads need to be diligently followed up and appointments made, and several meetings are usually required before a prospect joins the network. While some consultants will sell franchises on a commission-only basis, others will insist on a monthly retainer plus a commission on every franchise sold.

United Way

Mazzios Corporation was the first restaurant company (beginning 1987) in the United States to enroll employees into a payroll deduction plan!

Day of Caring

Each year, Corporate Staff members work alongside restaurant employees in spending a day of “manual labor” in providing for the needs of one of the many United Way-funded agencies. Typical of the types of projects that Mazzio’s devotes itself to each year on the United Way Day of Caring include cleaning, landscaping, painting, fence-building, playground renovations and construction of out-buildings.

In 2007, Mazzio’s Corporation was the Oklahoma winner of the National Restaurant Association’s Restaurant Neighbor Award honoring restaurant companies that have gone above and beyond in giving back to their communities.

Meals on Wheels

Mazzios has 12 teams of volunteers who have been delivering meals every Tuesday to those in need since the late 80′s.

Mazzio’s employees volunteer their time to teach Junior Achievement’s Economic Literacy Programs at elementary schools in the area. Mazzio’s also provides a day of Job Shadowing to seniors at Tulsa’s high schools.

According to the CDC, childhood obesity has more than tripled in the past 30 years, and can lead to long term health problems like cardiovascular disease, bone and joint problems, type 2 diabetes, cancer and stroke. Our founders were pioneers in the explosive healthful dining segment; Nature’s Table was founded in 1977 before childhood obesity was a national concern. In fact, we were the first business in the entire state of Florida to offer fresh fruit smoothies.
